    HR ALERT: Title IX January 9 Ruling 1-9-25

    On January 9, 2025, a federal district court in Kentucky issued a ruling striking down the 2024 Title IX Regulations that took effect in August 2024. This ruling appears to apply nationwide and as such, has vacated the 2024 final rule, meaning that school districts will be back to operating under the 2020 regulations.

    HR ALERT: Nevada Supreme Court Clarifies Rules for Investigating Peace Officers 1-9-25

    On January 9, 2025, The Nevada Supreme Court granted summary judgment in the case City of Las Vegas v. Las Vegas Police Protection Association, Jonathon Burdette, and John Arvanites (Case no. 86089), providing important clarification on conducting investigations under NRS Chapter 289.

    HR ALERT: Windfall Elimination Provision Repealed 1-5-25

    On January 5, 2025, the Social Security Fairness Act (HR 82) was signed into law, addressing the Windfall Elimination Provision and Government Pension Offset. Upon implementation, this Act eliminates the reduction of Social Security benefits for individuals entitled to public pensions from work not covered by Social Security. The law is effective immediately and is retroactive to January 2024.

    HR ALERT: New Exempt Salary Levels Struck Down by Federal Court 11-15-24

    On November 15, 2024, the U.S. District Court for the Eastern District of Texas ruled that the Department of Labor (DOL) exceeded its authority when it issued regulations that increased the minimum salary threshold for exempt employees earlier this year.   The judge’s order not only invalidates the rule nationwide, it further overturns the increase that went into effect on July 1, 2024, setting the minimum salary threshold back to the 2019 level of $35,568 per year.

    This is a reminder that Nevada State Law provides, under certain circumstances, that an employee be released from work to vote.  The specific provisions are contained in NRS 293.463 (see below).

    REMINDER: New Exempt Salary Threshold begins 7/1/24

    The first increase to the exempt salary threshold slated in the Department of Labor’s Final Rule released by the Department of Labor in April goes into effect July 1, 2024.  As of this date, the standard salary threshold for exempt employees will be $844 per week ($43,888 annually).  Exempt employees making less than this amount will need to be converted to hourly or their salary must be increased.
